Terms of Service

1. Agreement
These terms govern your access to and use of the CareOps IQ platform. By creating an account or using the service you agree to them. If you use the service on behalf of an organisation, you confirm you have authority to bind that organisation.
2. The service
CareOps IQ provides software for care-home operations, including CQC compliance tracking, rota and agency management, hours confirmation, payroll preparation and staff self-service. Features may change as the product evolves.
3. Accounts and security
You are responsible for keeping login credentials secure and for activity under your account. You must ensure that only authorised owners and managers are granted access, and that access is removed promptly when someone leaves.
4. Customer data and responsibilities
You retain ownership of the data you enter. You are responsible for its accuracy and for having a lawful basis to process it, including any resident health information. Our handling of personal data is described in our Privacy Policy and, for business customers, a Data Processing Agreement.
5. Acceptable use
You agree not to misuse the service, attempt to gain unauthorised access, upload unlawful content, or use it in any way that breaches applicable laws or the rights of others.
6. Availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. We may carry out maintenance and will try to minimise disruption.
7. Fees
Where the service is offered on a paid basis, fees and billing terms will be set out in your order or subscription. Applicable taxes may be added.
8. Intellectual property
We and our licensors own all rights in the platform and its software. These terms do not transfer any of our intellectual property to you.
9. Liability
Nothing in these terms limits liability that cannot be limited by law. Subject to that, our aggregate liability is limited to the fees paid for the service in the twelve months before the claim, and we are not liable for indirect or consequential loss. This is a general template and specific limits should be set with legal advice.
10. Termination
Either party may terminate in accordance with the applicable order. On termination you may export your data for a reasonable period, after which we may delete it.
11. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
